New Directive 2009/48/EC of the European Parliament and of the Council on the safety of toys impose on the producers, importers and distributors these new requirements:

  • Every toy has to be traceable (the producer has to be identified, the producer has to identify anyone, to whom the toy was distributed, and vice versa the importer has to identify the one who produced the toy and to whom the toy was distributed later on, distributer has to identify the subject from which he received the toy.
  • When a toy is placed on the market, the manufacturer must draw up an EC declaration of conformity (which has not been required recently) and the manufacturer or the authorized representative established within the EU must keep the EC declaration of conformity for ten years after the toy is put on the market.
  • Before the toy is placed on the Community market, it must cover the various chemical, physical, mechanical, electrical, flammability, hygienic and radioactivity hazards that the toy may present.
  • Toy firmly attached to a food product shall be prohibited (toy contained within food or co-mingled with food must have its own packaging).
  • List of metal elements, whose content it is limited within the toy material is expanded from the original amount of eight metals up to the nineteen elements.
  • A toy intended for use by children under 36 months must be designed and manufactured in such a way that it can be cleaned (toys made of textile shall to this end, be washable). The toy shall fulfil the safety requirements also after having been cleaned.
  • Specific warnings and indications of precautions to be taken when using certain categories of toys, were considerably expanded and completed (they are listed in the annex No. V. “Warnings” of Directive 2009/48/EC)
